This article examines recent developments surrounding the Resale Royalty Right (RRR) in the context of proposed amendments to Malaysia’s Copyright Act 1987. Beginning with the question of whether artists should continue to receive economic benefits when their works are resold at higher values, the article explores how the RRR discussion in Malaysia is gradually shifting from conceptual debate towards the development of a more detailed implementation framework.
This article examines recent developments surrounding the Resale Royalty Right (RRR) in the context of proposed amendments to Malaysia’s Copyright Act 1987. Beginning with the question of whether artists should continue to receive economic benefits when their works are resold at higher values, the article explores how the RRR discussion in Malaysia is gradually shifting from conceptual debate towards the development of a more detailed implementation framework.
Drawing on participation in a technical stakeholder engagement session concerning amendments to the Copyright Act 1987, the article outlines several key components under consideration. These include the recognition of RRR as a statutory remuneration right, the definition of eligible original visual artworks, qualifying resale transactions, royalty rates and thresholds, reporting obligations, inheritance rights, and the responsibilities of art market professionals.
The article also examines the proposed role of a dedicated Collective Management Organisation (CMO) to centrally manage royalty collection, transaction records, beneficiary identification, and distribution. At the same time, issues such as governance, transparency, data protection, administrative fees, digital artworks, limited editions, and unclaimed royalties are identified as areas that require further policy refinement.
Overall, the article argues that the RRR debate in Malaysia is entering a more mature phase, moving beyond the question of whether such a right is needed towards how it can be designed in a fair, practical, and locally appropriate manner. This development represents an important step towards clearer recognition of visual artists’ position within the economic value chain of the works they create.
